Rules and Regulations
Robstown Cemetery Assn., Inc. dba Robstown Cemetery (the “Association”)
Rules and Regulations
The following rules and regulations apply to all graves, all columbarium, and all cemetery grounds at
Robstown Cemetery, located at 801 N. Upshaw Blvd., Robstown, TX. By following these guidelines, we
can better take care of the general appearance of the cemetery as the Association aims for a peaceful
setting for all who are laid to rest at the cemetery, and its visitors.
Payment for grave plots or urn niches and permanent care fund fees must be submitted before burial will
be allowed. A concrete liner or vault is required. All graves shall be left FLAT. Only one single headstone
on each grave with the exception of a double marker for Husband and Wife buried side by side, if desired.
Nothing else may be put on graves. (This includes benches, bricks, curbing, fencing, lights, slabs, shells,
or any other material or item that would hinder mowing; this also includes figurines, flags, flag poles, flowers,
gardens on top of graves, glass containers, plastic eggs, rocks, shrubs, stones, trees, wire or metal objects,
etc.) The grave space shall have only a grass ground cover. Robstown Cemetery Assn., Inc. reserves the
right to remove any items not allowed.
One floral arrangement, artificial or fresh, may be placed on monuments, but must be removed when they
become discolored or unsightly. Please remember to come back and remove when needed. When you
visit, please bring a trash bag, and clean debris from around the area you visit and place bags in the onsite
waste containers. There are several waste containers in the cemetery that may be used for disposal of old
flowers, trash, etc. The Association asks all to adhere to the Floral Policy that is provided on and near trash
receptacles and also on the cemetery website, RobstownCemetery.org. All items in violation of the Floral
Policy will be removed by management services at the end of each EVEN month.
The Association reserves the right to video for security purposes within the cemetery.
All monuments and foundations must be installed by a monument company. Only granite, marble, or bronze
may be used for monuments and markers. Any concrete/wooden markers are subject to removal by the
Association. If you wish to have a monument installed, and to ensure cemetery guidelines are met, please
contact, or have your monument service provider contact the Association for correct marking and
placement. In Section D, only flat grave markers are allowed at the head of the grave. All spaces shall have
a permanent marker installed within 2 years of burial. Headstone or monument maintenance is the owner’s
responsibility.
NOTICE: ABANDONED PLOTS. After a burial plot has gone unused for ten (10) years from the date of sale
and based on the records maintained by the Robstown Cemetery Association (the “Association”), the
Association shall provide the owner of the plot with written notice that the plot shall be considered
abandoned and revert back to being owned by the Association. On the 90th day following the delivery of
the aforementioned notice, the plot shall automatically revert to being owned by the Association unless a
response to the notice is received prior to the deadline by the Association which notice must contain a
statement that the owner or the owner’s successor(s) in interest intend to retain their interest in the unused
burial plot and agree to reimburse in full the Association for any and all past due maintenance charges on
the plot plus interest at the maximum legal rate. It is expressly understood and agreed that the provision
contained herein deviates from the requirements under the Tex. Health & Safety Code § 714.003,
and although the rights under the statute might be considered better than the rights herein granted,
the parties expressly agree to waive the requirements under the statute. Furthermore, the parties
expressly agree and understand that this provision may result in the termination of ownership or
right of sepulture in the plot without court action or other legal process.
It is the responsibility of plot and columbarium niche owners and their families/trustees to keep the
Association apprised of their current mailing address at all times.
